Kathmandu. KATHMANDU: The Supreme Court (SC) has issued an interim order in the name of the government to guarantee the education, health, housing and other basic rights of children displaced from the squatters on the banks of the river and other places. <\/p>\n
A single bench of Justice Sapana Pradhan Malla issued the order on August 3. In a preliminary hearing on a writ petition filed by Barun Basyal and others on behalf of Informal Sector Service Center (INSEC) Bagmati Province Office, the apex court has stated that the displacement has caused serious impact on children’s education. <\/p>\n
The court has ruled that it is necessary to ensure the admission of displaced children to school, continuity of education and access to basic services. It states that the school-going children of the landless areas could drop out of school, unenrolled children could be deprived of their right to education and their life and development could be adversely affected due to the displacement. <\/p>\n
The court has concluded that it needs immediate protection based on the report of the National Human Rights Commission and also the issues of public concern. <\/p>\n
KATHMANDU: The Supreme Court (SC) has ordered the government to continue the education of the children enrolled in the school by identifying and verifying the displaced children and compulsory and free admission of unenrolled children in the nearby school within mid-July. <\/p>\n
Likewise, free textbooks, uniforms, transport facility, educational materials, psycho-social counseling and support services for children with disabilities have also been asked to be provided. <\/p>\n
The apex court also directed the government to make arrangements for residential education as per the need and to coordinate with the local bodies to create a conducive environment for the children if there is further impact from the displacement. <\/p>\n
Likewise, the order states that temporary arrangements for pregnant women, people with disability, senior citizens, children and sick people should be ensured with quality accommodation and necessary health services as per their special needs. <\/p>\n
The petitioners have demanded an interim order for protection of education, health and other fundamental rights of children displaced from the slums. <\/p>\n
Pointing out the need to protect education, the rights of children, the right to live with dignity and the right to housing guaranteed by the Constitution of Nepal, the SC issued the interim order. <\/p>\n
The court has also directed the concerned respondents to implement the order as per the rules. Senior advocate Raju Prasad Chapagain, advocates Gaurav Baral and Hemanta Raj Pahari had pleaded on behalf of the petitioner.<\/p>\n","protected":false},"excerpt":{"rendered":"
