Kathmandu. The Law, Justice and Human Rights Committee has discussed the reconciliation bill with the stakeholders.

Minister for Law, Justice and Parliamentary Affairs, Sobita Gautam, underscored the need to make the mediation process effective to make the process of justice delivery quick, easy and costly.

She said that the citizens have to face various problems due to the existing judicial process which takes a long time from the registration of cases to the execution of the verdict. She said that the citizens who go to the court for justice should find alternative ways to end the situation where they have to wait for years.

She said, “Mediation should be promoted as an important and effective alternative to justice. If the process of conciliation is adopted in the beginning according to the nature of the dispute, the pressure of cases in the court can be reduced and the citizens can get justice faster. The need of the hour is to find an alternative to end the situation of fighting cases, taking a long time to get a verdict and problems in implementation even after the verdict has been delivered. The person who goes to the court to get justice should focus on what processes he or she has to go through and how to make those processes easier. Reconciliation is one of the most important and effective of these options. ’

She said that as the number of cases in the court is increasing, there are also public complaints that there is a delay in the delivery of justice. She said that if the disputes of the nature of reconciliation can be resolved before entering the court, the court can give more time to important cases that need to establish constitutional and new legal precedents.

Minister Gautam said that due to prolonged litigation, the financial expenses of the citizens increase and the relationship between the two parties also deteriorates. She said that the situation of citizens getting entangled in the legal process for years due to small disputes should be ended.

However, she clarified that such a process can be followed only in cases where the law permits reconciliation or reconciliation. She said that since reconciliation cannot be done on the issues prohibited by the law, there should be a clear provision in the bill on what can and cannot be reconciled.

She said, “We should envision such a judicial system where citizens do not have to wait for years for justice, do not have to face financial burden and mutual relations are also protected. The aim is that the society should move forward in a harmonious manner.” ’

Minister Gautam said that the main objective of the bill related to mediation is to provide justice to the citizens in time and seek easy solution to disputes.
