Hearing on Pashupati Gaushala Dharamshala case underway

Kathmandu. The hearing on the case of Pashupati Gaushala Dharamshala under the Marwari Sewa Samiti is taking place today. The committee had filed the case at the High Court after the Kathmandu District Court on October 30, 2081 ordered that Pashupati Gaushala Dharamshala would be under the ownership of the Pashupati Area Development Trust.

The Marwari Sewa Samiti has so far adjourned the hearing of the case four times. The committee has resumed business at Pashupati Gaushala Dharamshala, which was set ablaze during the Jenji agitation. The court has so far issued only a general order.

On May 26, 2006, when businessman Basanta Chaudhary was the member secretary of the PADT, an agreement was reached with the Marwadi Sewa Samiti to use the property of Lord Pashupatinath for Rs 51,000.

Earlier, the Kathmandu District Court had ruled that the Pashupati Gaushala Dharamshala, which has been under the ownership of the Pashupati Area Development Committee, which has been under the possession of the Marwadi Sewa Samiti for the past 21 years, has not been entitled.

“There is no such institution by the name of Pashupati Gaushala Dharamshala in existence since ancient times. This fact appears to have been accepted by the plaintiff Marwari Sewa Samiti while entering into an agreement with the Pashupati Amalkot Court on May 26, 2000,” the judgment reads.

The verdict states that although there is no dispute over the fact that the land belongs to the Guthi registered at Pashupatinath Amalkot Court, a photocopy of the same was submitted stating that the tenant was registered at the Pashupatinath Amalkot Court and the certificate of registration of the land was obtained from the Mohi Mahal.
