Kathmandu. KATHMANDU: The Supreme Court (SC) has struck down a provision requiring a single widow to return the property inherited from her former husband if she marries again.

Acting Chief Justice Sapana Pradhan Malla, Justices Kumar Regmi, Hari Prasad Phuyal, Dr. Dr. Manoj Kumar Sharma, MD The constitutional bench of Justice Nahakul Subedi has scrapped the provision of Section 214 (2) of the Civil Code Act, 2074.

Clause 214 (2) of the Civil Code, 2074 BS states that if a widow marries again, the property received by her as a share shall be inherited by such a widow if the children are from the previous husband and if not, she herself shall take the property.

Senior advocate Meera Dhungana, on behalf of Women Law and Development Forum, had filed a writ petition challenging the provisions of the Constitution of Nepal against the right to equality.
